I. Acceptance of Terms:

BY ACCESSING OR USING THIS WEBSITE, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS (COLLECTIVELY, “THE TERMS”) SET FORTH HEREIN BY MY PRODUCTION CREW™ (“MPC”, “OUR”). IF YOU DO NOT AGREE TO ALL OF THE TERMS, DO NOT ACCESS OR USE THIS WEBSITE.

II. Copyright and Restrictions:

Website – All content included or available on this website, including, but not limited to, photos, videos, design, text, and graphics, is the copyrighted property of MPC (collectively, “MPC Content”), with all rights reserved. Any form of data extraction or data mining, or any other commercial exploitation of any kind, without express written permission of MPC is strictly prohibited.

Products – All photographs or videos taken or created by MPC and distributed on this website as products, or included with products, remain the copyright of MPC, and are licensed, not sold, for the listed price to you (“The Licensee”) for the right(s) to print, publish to the web, distribute, or display for personal use only. Any license included with a product supersedes these terms.

All product images, videos, or galleries (collectively, “Product Proofs”) are displayed on this website for ordering, proofing and viewing only. Product Proofs must not be saved, used, published, or printed.

III. Trademarks:

The company names and logos of MPC used on this website may be trademarks, registered or unregistered. Such company names and logos may not be copied, imitated or used, in whole or in part, without the express written consent of My Production Crew™.

All other trademarks displayed on this website are the trademarks of their respective owners, and constitute neither an endorsement nor a recommendation of those Vendors. Such use of trademarks or links to the web sites of Vendors is not intended to imply, directly or indirectly, that those Vendors endorse or have any affiliation with MPC.

V. Products:

Storage & Availability – Photos and videos captured by MPC and linked to a production number will be listed as products and available for viewing and ordering within 24 hours after being shot. All products will expire after 7 days, and, once expired, you must request an additional 7-day extension to access your content. A 25% extension fee will then be added to the final price of any product ordered.

Image Culling – All images captured by MPC are put through a careful selection process for quality control. Only those images meeting our standards will be listed and available. MPC reserves the right to discard any images for any reason at its artistic discretion.

Pricing – The listed prices of products do not include sales tax, if any, and shipping costs, if any. MPC reserves the right to change product prices at any given time and without notice prior to accepting your order.

Orders – There is no binding contract until you have been charged and your order has been accepted. By placing an order for a product, you agree to the total order price, and you authorize MPC to collect payment via the payment method that you specify. MPC reserves the right to refuse or cancel any orders placed for a product listed at an incorrect price due to typographical, photographic, or technical error.

Delivery – The following time frames are expected but not guaranteed, and may change due to unforeseen circumstances. MPC cannot guarantee that there will be no delays in delivery, and accept no liability or responsibility for delayed delivery of products where the delay is outside of our reasonable control:

Downloadable Products (Individual) – All download links will be available immediately after payment.

Downloadable Products (Bulk/Collection) – All download links will be available within 24 hours.

Physical Products – All physical products will be processed and shipped within 7 days.

Returns, Refunds, & Cancellations – Due to the nature of our business, all sales are final, and no returns, refunds, or cancellations will be granted.

VI. Warranties & Disclaimers:

THIS WEBSITE, INCLUDING ANY AND ALL LISTED PRODUCTS, IS PROVIDED BY MPC ON AN “AS IS” AND “AS AVAILABLE” BASIS AND WITHOUT WARRANTIES OF ANY KIND. MPC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THOSE OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. MPC DOES NOT MAKE REPRESENTATION OR WARRANTIES THAT ANY MPC CONTENT WILL BE ERROR-FREE, THAT ACCESS THERETO WILL BE UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, OR THAT THIS WEBSITE OR THE SERVER IT RESIDES ON IS FREE OF ERRORS, VIRUSES OR OTHER HARMFUL COMPONENTS. MOREOVER, YOU ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION. MPC DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF ANY CONTENT.

MPC AND ITS AFFILIATES AND REPRESENTATIVES WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND, INCLUDING, BUT NOT LIMITED TO, DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, PERSONAL INJURY (INCLUDING DEATH) AND PROPERTY DAMAGE OF ANY NATURE WHATSOEVER, FROM THE USE OF THIS WEBSITE, INCLUDING ALL CONTENT AND PRODUCTS THEREON, WHETHER SUCH DAMAGES ARISE IN CONTRACT, NEGLIGENCE, TORT, UNDER STATUTE, IN EQUITY, AT LAW, OR OTHERWISE, EVEN IF MPC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
